1. The rules regarding Pension & PF of CG are different, and not governed by EPFO. Presently employees joining CG after 2004 are governed by NPS (which is contributory & non-GPF). In such case you would have no option, but to withdraw your balance from EPFO. (However, if you are going on deputation, then I am not really aware as to what rules would apply.)

2 & 3. Taxability is not related to withdrawal – it relates to period of service. If period of service is 5 yrs or more, then the withdrawal is not taxable. If you join after your exams, then there is no need of 112.

As per rules, you cannot re-start from scratch.

There are only two situations where you can terminate without your Principals signature – that is through Form 120. The two situations relate to 1) Transfer of parent, 2) Medical reason

Now a days in general, employment provides high salary from the very beginning.

However, there is no direct linkage between the kind of firm one does training & what kind of work one actually does (or even the field one actually works) after qualifying. Passing the exams is more important than just training. Training is mandatory – it should be done. However not everyone lives in big cities or can get into big firms – but that does not mean that they are less than equal.

Ask him to write a letter to institute that your 103 was sent in error as the eligibility for articleship was not completed, and therefore your 103 should be considered void.

Thereafter, after completion of your Orientation do the process of 103 & 102 again.

2. No. In the fields that you mention, CA is just another qualification competing with other finance qualifications. However in field of Corporate Finance (like say officers working in finance dept of a company), often CA s & CWA s would be preferred. In other fields its MBA s of good institutes.

4.If you are thinking of dummy – dont do CA. The only edge that a CA has over other qualifications is the articleship. However nearly all qualifications have some sort of training.viz. CWA has 3 yrs, CS has 15 months, MBA usually do a min 2 month training as part of course work. These also depend on opportunities & luck.

Previously, the rule was that the orientation had to be finished prior to appearing in IPCC Grp 1 exam. However that was later relaxed to completion prior to joining of articleship.

Just that you have filled 103 & 102 & sent the form to institute does not mean you have commenced articleship. You cannot start articleship unless you get the eligibility to do it. And the eligibility includes completion of orientation prior to articleship.

Every student has to take a formal approval before signing of FORM 109. It is clearly mentioned that “Principal and articled assistant should forward Form 109 duly signed by both of them only after obtaining the prior permission of the Institute for transfer/termination”….

Hence i want to know what is the exact procedure for such approval…

109 is usually sent within 30 days. The rule for 109 is actually not clear – as usually its 30 days – but till some years back, when the institute used to issue it from branch, the 109 form used to be valid for 60 days.

A condonation letter (providing reason for delay, preferably signed by your Principal) and fee for delay has to be sent alongwith the 109. Remember that 109 is basically being sent by the Principal (ie. the correspondence is between the Principal and institute) – it does not matter who is posting the letter.

As for extra hours worked – those are noted in the attendance register. If that is not done in your firm, then I am not sure what kind of proof you can produce

As for extra payment for extra work done, that is really an understanding between you and your Principal. There is no rule that refers to such situation – and it is really a debatable matter. However, by the general rule of articleship, during the three years of training, the only thing you can do is articleship – and you cannot enter into any other agreement other than the 102. So, the claim that you have been paid more for excess hours and therefore set off would not be given – in my understanding that is not in the right spirit of the articleship rules.

Moreover as far as I know, ICAI does not interfere in such matters. ICAI would interfere if you have not been paid the minimum stipend. In other matters, you have to deal the situation by yourself.

Also, as soon as results are out, you should buy the requisite Stamp Paper – because articleship can start only after the date mentioned in stamp paper.

I have served my firm for 1042 Days.
Hence my eligible leave would be i/6 of the period served i.e 174days.
Total leave taken by mee during my A’ship is 236days.
My principle’s giving me an extention for the exces leave taken of 62days.

But i have served for extra hours and even not been paid for my eligible leave.
On arguing regarding the set off of excess leave taken by me with the extra hours worked, the principle states he has paid me above the norms of ICAI.

Kindly help me provide enough evidence as to state my claim just and right to my principal.

All kinds of desk job is basically ‘clerk’ jobs.

It is only a matter of social set up, that those who are more educated and are able to extract more income prefer to be called “Manager” & “Officer” – otherwise nature of work does not differ much.

So dont worry about all these things. During my time, I found that in concurrent audit of banks, the most important person was the peon, who (knew the location &) would bring out the files for audit!

In this line, you would have to work with persons from peon & guards to that of GMs & Directors. After getting few months exposure, you would only laugh at all those things called ranks & designations.

Your focus should be on what you learn.

The difference is that you may not get exposure to Blue Chip companies, other than audits of branches of banks & insurance companies.

At Jabalpur, there are also firms that were even CSA (Central Statutory Auditors) of Banks !

As for TATA, a student can do industrial training only if s/he is in Final and in last year of articleship. For the first two year, it has necessarily to be a CA Firm.

ICAI would send letter saying something like that so much of amount towards Final registration has not been sent – and when that would be sent the articleship registration letter would be issued.

While passing the CA finals, perhaps you can go for employment (other than CA Firm) – for that you dont exactly need to be a member. Depending on the kind of work, you may also get exemption from 15 month CS training, and wait for the time till you are eligible for CA membership

I am in CA final stage.But also enrolled for CS during my articles.My case is -
I started my articleship under CA on april30,2007. In month of august,2007 i also enrolled for CS but i didnt realised that I was suppoose to take permission for the same from the institute.
But now my articleship is over in october ,2010 and have also completed my CA PCC ,in nov10 and also cleared my CS Executive in dec,10 examination.
In january I went to the institute for obtaining permission for CS,but they refused to grant me permission saying since my article is over nothing can be done now and i will have inform them at the time of obtaining membership.
But now my major concern is that every delay will increase the ban period(delay in memebership),as per institutes rule, on me,as the period of delay is already 4.5 years I will be banned for 1 years and if it gets to 5 years the ban will be for 2 years.

It is actually simple. ICAI exams are held in May & Nov. So ICAI takes exam on the ‘current’ AY

Which in this case of May & Nov Exams in 2012 would be AY 2012-13 (ie. AY starting from 1 Apr 2012 to 31 Mar 2013)

If you are originally from PE-2, then you would be able to appear in Finals in last one year of articleship (provided you reach the finals). There is currently no limit on appearance for passing the exams.

I would suggest that instead of just relying on email or phone go and visit some and meet the CA s.

That way there is a greater likelihood of getting articleship.

Also there is no concept of transfer “without any valid reason”. Even first year transfer has to comply with the rules of ICAI which is that the Principal has to agree. It is called termination by “mutual agreement” (102 is an agreement. It can be terminated only mutually!). Principal would agree for such termination only if you have some valid reason !

Loan / withdrawal for higher studies is provided by EPFO. The link clearly says: For education of : self, son, daughter

The rule is “Para 68 K”. reading the provisions, it seems that originally it was for marriage, but later on education has also been added to it. You will have to use Form 31 for it.

But why dont you try the easier education loan from bank like SBI? They provide for studies in India, maximum Rs. 10 lacs and for Studies abroad, maximum Rs. 20 lacs. Usually if its courses like engineering / medicine, these loans are easy to get.

Where possible, its always better to take loan rather than reduce your EPF accumulation by part withdrawal

As far as I understand, the rule of 120 has now been changed. Now 120 can be used only for 2 reasons viz transfer of parents and medical reasons. Plz read the instructions given in Form 120 – so you will understand it (previously those restrictions were not there)

However in my view under any circumstances, things should not come to situation of 120. You should always maintain a cordial relation with your Principal.

It is not your responsibility to pursue the matter with your previous employer. RPFC has penal powers if any company does not provide information / returns / challans. It is another matter – that they do not exercise it, and in India mostly there is a chalta hai attitude.

For CA articleship there is absolutely no exemption. Infact those who are employed in such fields of accounts etc for any number of years – even if they want to do CA, they would have to first resign and then do articleship.

Max leave in three year articleship is 155 days. Anything excess would be excess leave

At some point of time ICAI would definitely have to do the revision. Usually such revisions take place once in 10 to 15 years. If my memory serves right, the last revision took place sometimes in 2002 / 2003

4. The perception of training differs from person to person. Though it is called ‘training’ – no one actually provides training in the sense of telling that you have to do this and that. Usually its more like self-learning. You have to know a thing beforehand, else you wont get assigments! In one of the firm where I worked, my Principal would have very little time. Usually in the morning, his assignment method was like – “this relates to capital gain – can you do it?” If one said yes, then it would be assigned – and if one said that one had not studied capital gain provisions or say something stupid like – is it difficult?- then that would be assigned to someone else who knew!

I would suggest secondment as preferable to transfer, because, it usually happens that a firm that has much work gives very little leave – and that leads to problem when one wants to prepare for the exams.

The date of termination is the one put in form 109. Once terminated you are free bird. You can join any CA of your choice anywhere. If its the same city, you can start the next spell of articleship from the very next date.

However unless you have some real emergency reason, 2 months is a very short time.

This new rule as on date is approved but not yet notified. Only ICAI can say when this will happen.

Only when the scheme is notified in the official gazette of Govt of India, will such thing come into implementation

Articleship can be done anytime if you are eligible. However one should know that in the past 10 years, ICAI has changed the CA scheme of exams and training four times. The plain fact is that you will have to attend office for a period of three years – no less no more.

So, it does not really matter whether your Principal counts that period as leave.

Because until you really join some other firm, your new training does not start.

So basically you neither gain nor lose.

The thing is you should ensure that you get the 109 signed prior to leaving.

You do not need to wait for your registration letter for sending form 109

However, you cannot just say that you have discontinued. Discontinued means that form 109 have been signed. Form 109 has to be sent to the institute within one month of date of termination

Infact, even a photocopy is also good enough for records – as one needs the photocopy only for the purpose of writing exams and for getting certificates issued by ICAI !

The original one is always with your Principal from where you completed articleship – as the original copy is sent there – the student is only sent a carbon copy of the original

Moreover, ICAI has a clear policy of not interfering unless there is violation of any specific rule. So you have to convince your Principal. Better talk to him – three months is a very less time for transfer. May be talk with him – that you would do training for upto 6 months, but because of travelling and other reasons, you want transfer. Its always better to talk with reason than to have ill will based on emotion. After all, it was your decision to join him for articleship and you signed deed for three years ! So have patience and talk / negotiate !

To the other point – there is no rule of ICAI where one can start articleship training afresh.

In both these cases of recruitment, the prescribed educational qualification is a graduate degree. Having any other qualification neither adds to recruitment preference nor to promotion or increment.

Firstly define for yourself what you mean by “Corporate Financial Management” – that will help you to shortlist the kind of sector you want to work in. Corporate FM for a Power company would be completely different from say a Banking company – and so on

1. Articleship is a unique and very exciting training. However, each and every area is filled with lots of checking of facts and rules. So, if someone thinks that any of the field is ‘exciting’ – then it is not. To the layman – every field is ‘dull’. Everyone is free to have their perception of any field of work. But there are CA firms in India who specialise in internal audit ! So, IA cannot be that bad an area? In my opinion, all these areas supplement each other in different ways.

2. Tax changes every year ! And particularly in Income Tax, the whole legislation is likely to get changed ! Dont look at ‘whatever is being offered’ – see if that adds value to your aspirations.

3. There is no direct link between what one does in articleship and what one does after one qualifies. If one prefers to and gets opportunity in the same area, then it is really good. However there are various people who having being exposed to one area for long develop fatigue to that kind of work – which in a way becomes monotonous!

4. As to an area being lucrative – every area is lucrative. However taxation & consultancy is considered more lucrative than others.

5. In my understanding, the widest learning is possible in IA. However for majority of students in IA, they are exposed to only certain aspects, while other team members look after other aspects. It is perhaps this segregation that becomes a bit unsettling from student perspective. Similar is the case with Statutory Audit. While in IA one gets lots of time to study details, one does not have such time for Statutory audits. But statutory audit, by its very ‘statutory’ nature is considered more prestigious. When one goes for statutory audit, one is treated as a VIP.

6. Articleship should be understood as part of the process of becoming CA. It is not an end in itself. Learning for its own sake has no value. And as to work – one would have to do the work assigned, even if one does not feel it interesting. For example. often, in doing tax work (80% to 100% of tax work at articleship level would relate to computation and return preparation), while previously there were no softwares, so one would study the rules and apply them. However from the time the tax softwares have become popular, one has got reduced to being mere data entry operator! – so while the quality of output has improved, learning has declined sharply – as now everything from application of rules to calculations is being done by software! In bigger firms even audit to some extent has become mechanised – but audit is different from mere checking. It is checking an entry in relation to rules viz – AS, Taxation, Compliance (like EPF) etc that still make audit interesting.

7. One should also remember that there is to a large extent a disconnect between what ‘practical aspects’ one learns in articleship, and the CA exam. Barely if 20% of what one has done in articleship is useful from CA exam perspective.

8. Many do training in Big4 just for the Tag. However there are other bigger firms and also mid-size firms that are equally good. The point is that the student should not feel ‘harassed’ – but enjoy doing the work that s/he is doing. I was offered Internal audit in one of the Big 4 but my friends and relatives say that it can be dull and not as rewarding as other areas like Statutory audit or Tax.

I enjoyed studying tax and feel that I would like to learn and work in the Tax department. Is it ok to accept whatever is being offered to me in the Big 4 as my aim is to seek employment after becoming a CA? Or should I find such firms that have vacancy in Tax (may or may not be Big 4)?

Be it any firm, you have to fit to the work culture – as work in every firm is driven by the particular Partner incharge.

While retrospective registration under his Partner would seem logical, it is not legally right. Reason: You cannot legally sign an agreement backdated. 102 being a legal agreement, you have to date it on the date of signing.

The only procedure is that find a CA – check whether he does not have his vacancy full, and register under him. You can register in the same firm under a different CA. Remember that articleship is under CA, not under Firm. So, you have to start again from the beginning. Yes such situation is definitely annoying – and the CA should have taken due care in keeping track of articleship vacancies under him.

So you can again start to pursue the matter after a week / ten days of sending the DD.

ICAI now a days does not send the registration letter if some fee is pending (but it does send intimation of that) – may be they have posted or not posted that intimation or it has got lost. But that does not nullify the period of articleship. So speak to the concerned articleship section of your region – and find out what exactly is the status of your 103.

So dont worry – but pursue the matter with cool head.

I understand your question and the stage you are in as i am also in a little similar situation.
I also had same question and i did ask it to Anup sir, you can find in earlier questions of same blog.
I did some reseaarch in this, and found that there is a position called Finance Controller where people like us, engineer with degree like ICWA is highly preferred, and perhaps scarce in the industry.
This is mainly because this position demands control on finance and cost aspects and guide the management about furture strategies of Capex, as far as financial aspects are concerned.
I feel that as you are going to be in Project Management function, better to horne your skills of Project control & costing aspect which may be counted some relevant experience by the time you complete your ICWA and we might not have to start as a “Trainee” but yes, it can be a Junir level positions like Deputy manager/ Manager tag. But i believe that because of the logical ability and ability to learn the knowledge of technical aspects quickly it is easy for engineers to translate it in a finanical terms and reports.

If you are late in sending 103 (beyond 30 days), then that has to be accompanied by (1) Original deed in 102, (2) attendance records, (3) stipend proof

However, logic would suggest that notwithstanding qualification, if someone is to be recruited for some senior position, then some experience is to be expected in that field.

Exceptions may exist if one is working in the same organisation- where one can be provided senior position in a completely new area based on the newly acquired qualification

In terms of qualification, exec MBA or even MBA from non A level B schools, do not stand anywhere near CWA. CWA is a statutory qualification which MBA is not. (eg. in the draft Companies Act, there is a provision that every company will have to keep a Chief Accounts Officer who has to be a CA or CWA). Besides CWA has statutory recognition for cost audit under companies Act & Central Excise Act, if in practice, CWA can represent clients in front of Taxation authorities (Income Tax, Central Excise, Customs, Service Tax) as well as at various tribunals like Competition Commission etc.

However, as with every qualification, they come with limits. To put it in a simplified manner – for an organisation, CWA would be the backend, whereas MBA would be the frontend. Besides in organisations qualification works only to a point – after that its the ability to deliver on basis of which a person is chosen for assignments.

However as for relevance of CWA to your situation, there is no straight answer to this. That really depends on the organisation you work in. In many engineering organisations any specific qualification like CWA is not really emphasised (unless one is shifting to core finance function)- as things like project management is often made up through internal training.

The point to remember is that as you dont have relevant prior experience, do CWA only if that is useful in your existing organisation. Because if you want to join another organisation – basically – initially you would stand in the same situation as any new CWA without experience.

2. The career can relate to costing (relating to manufacturing) / compliance (like tax & excise) / finance (functions like salary, cash management, budgeting, accounting etc) / project management (formulation to implementation)

Secondly, you can serve the excess period under your existing CA in continuation (preferable) or under another CA

Thirdly, as far as I know, there have been cases where for the period of minimum 9 months, ICAI would club the excess leave service period for the purpose of industrial training.

So, I guess you should be able to do industrial training. However duration of industrial training is max 1 year & min 9 months. So you will have to first do the balance period of training under a practicing CA.

Else there is no difference – you get the same certificate, and give the same exam.

As you are already in second year, it would be difficult. However, I would suggest that as ICAI has all the over-riding powers, give a representation (duly forwarded by your Principal) to ICAI and wait for their reply.

TP is good – as it is multidisciplinary – having inputs of taxation and costing. If you are getting training in TP area – you would be working with MNCs – as TP is relevant only in trans-border cases. Even in practical field TP has great value. Income Tax dept in India has a separate directorate to deal exclusively with TP

Your Principal maybe convinced or remain unconvinced with your reason

(for example with your reason, your Principal may say that the Firm provides the best training, and you are intelligent enough that you dont need any coaching !)

For additional course Form 112 is required to be filled. If the college timing clashes with office timing, ICAI would consider you are not taking training. (It does not matter whether you are attending classes or not)

As to what is the better option – articleship in big4 or abroad – I would say, in the end what really matters is where you land with the job or what kind of work you would do after articleship. Join the articleship where you would have least tension and max exposure / rotation

After qualifying CA, practice can be done in India only (ie attestation of audit reports). Employment can be done anywhere in world.

Usually Articles are not given leave as soon as they join – but as you have a valid reason – you may be able to convince.

To the other part, it would really depend as to what kind of work you are doing at Bank. Bank is a place of great learning opportunities. I have seen CAs who have not done concurrent audit either as Article or while in Practice – and they really crave to get an opportunity to do bank concurrent audit!

Its actually you will have to ‘create’ work for yourself by examining more documents and improving your quality of understanding of the systems and procedures of the bank. I would really suggest put in a few more months – and also speak to your Principal about the nature and objective of your work. He would be in a better position to give you a better picture. You can also speak to him about job rotation.

I personally think that till you have a good Principal you should not take transfer. Taking transfer should be resorted to in an extreme situation that is out of your hands. When you are working in a firm, the more time you put in, you get more responsibilities over a period of time. Also try to interact more with your Principal /MIT – that would help you understand the importance of the different kinds of works that you are engaged in.

However at many places, things dont work perfectly – and the ITT is conducted for fewer hours a day and overall exceeds the 20 days. So the student is made to work at office and also attend ITT.

But in terms of rules, it does not really matter whether one is working at office or attending ITT – as both are part of articleship.

You can calculate, if overall you have put in net excess hours – then you can talk with your Principal for some set off.

1. (If you have not already factored this) Period of appearance in exam (including gap days) is part of articleship training. So that period you have actually served.

Under your region, there would be an option of “BOS”. Under BOS the option is “all matters relating to registration of Finals”

If they confirm, then just keep a printout of their reply. That is as good as confirmation.

Its a backward calculation and not forward calculation

Had it been the normal procedure of 109, you could have gone and joined another Principal the very next day – without waiting for the procedures

However in case of 120, the rules are not very clear. Because unless you are released by your Principal / or by Secretary ICAI, you cannot presume that you have been released (or for that matter unless you get an intimation in any manner that your 120 has been accepted by ICAI as valid, you cannot presume that you will get transfer).

If your Principal’s was a proprietory firm, then form 110 to be issued by legal representative

If your Principal’s is a partnership firm, then form 111 to be issued by surviving partner

For example under normal circumstances, after properly informing the Principal, the student has stopped going on 15th of October (but did not take the 109 on 15th Oct) – and later on visits his Principal for issue of 109 on 30th Oct. So Principal will issue Form 109 on date 30th Oct. But the date of termination in the relevant column (on first page) would be 15th Oct

It is the date mentioned in the relevant column on first page ie. from…..to……. that is relevant for determining the period of articleship undergone.

As you are doing additional course, you will have to fill form 112.

If you join between anytime from now upto 30 Apr 2012, your final would be due on Nov 2014

In my understanding of the rules you can join after your college has officially closed for exam holidays- as then there would be no ‘regular college’ (you should have some proof like copy of college notice to that effect).

For appearing in BCom exams you can take leave from articleship training.

But whatever you do get a confirmation from ICAI beforehand so that you are not put into unnecessary trouble later on.

That will save you further complication when you become CA

As to 120 – previously there was no condition prescribed for it. However, now, it has two conditions like Parent Transfer clause and Medical reason.

For using Form 120, you dont need consent of Principal – form 120 is like you are terminating your articleship by yourself

The rule is:

In case the Principal has not forthwith issued the Certificate prescribed under Regulation 61, on completion or termination of articles, the articled assistant shall make a request in the form 119 or 120 (as the case may be) approved by the Council, within 15 days of such completion or termination, to the principal, under intimation to the Secretary by registered or speed post, for issue of such certificate of service and the principal shall in any case, issue the certificate of service within three months of such completion or termination:

Where no such certificate is received by the Secretary within fifteen days of expiration of the period specified above, the certificate shall be deemed to have been issued on the date specified by the articled assistant, and an intimation to that effect shall be sent to the principal.

To put it simply, if you are covered by any of the two reasons on basis of which you can take self-termination, then after you have given Form 120 to your Principal and sent copy to ICAI, you will have a waiting period (of 3months + 15days + the dispatch time till you finally receive the written communication of your termination from ICAI) before you actually get the transfer.

As you had previously written that you have registered for articleship in Mar 2011, (and if you dont take any excess leave), then you would be able to appear in finals of Nov 2013

You can register for finals even in start of 2013 (that would give you updated study material). The only thing that you should be sure that you have all papers in place like your final registration before you apply for your exams.

As to firms in Nepal – I have no idea. I am also not aware if any branch of ICAI exists at Kathmandu. However, you can get that detail by writing to http://www.icai.org/help/

Sitting there for the full duration of three hours would help you prepare for the May attempt

As for GMCS – if the student enrolls for it while doing articleship – then it is considered part of articleship – it does not matter if the student is serving excess leave.

The last question leads to an illegal situation. Its like you are paying your Principal for dummy.

Principal is entitled not to pay only in situation of excess leave. Till there is no excess leave, s/he has to pay “regularly” (ie. on a monthly basis – s/he cannot say that s/he will pay 3 months of stipend together when you come back from leave) – at least s/he should have created a liability in his/her books and kept the cheque to be delivered to student whenever the student comes to office.

Apart from above, if the reason for leave is exam preparation, then as per rules, your Principal cannot deny you the 3 month leave http://www.icai.org/resource_file/201announ1125a.pdf issued by ICAI No.1-CA(7)/102/2007(E) dated 17-08-2007: the amended Regulation 59 (4) says (on page 7):

For the purpose of preparing for an examination of the Institute, the articled assistant shall be granted by the principal leave for three months or to the extent due, whichever is less, provided an application for leave has been made at least fifteen days in advance.

This leave is not at a single go – but can be taken at different time cumulatively. So if the reason is exam preparation, then leave over 3 months can be denied by Principal – however such fine distinction of 3 months exam leave is not usually made.

In practical terms there is only eligible leave (for whatever reason – exam or any other reason) and excess leave. For any eligible leave the student is to be paid stipend. For excess leave no stipend.

Also send a separate letter to your Regional Office writing that you find that your father’s name is incorrectly mentioned in records of the institute (no need to mention the source of ICAI exam – but if there is any other document like registration letter etc where such mistake is there then you can attach that) and attach proof like 12th marksheet or any other document (even copy of Form 103 would suffice) and request them to correct that.

I would suggest that first find a job and also simultaneously finish BCom

Starting everything is good – that would depend on your family support.

Also sense of responsibility and competence (ability) are two different things. It is easy to find situations in our own lives where we have done a thing with responsibility – but we simply lacked ability to do that – and that lead to undesired outcome.

So while you finish your BCom see how good you are for commerce field – try to see whether you really “love” it. If you can find any CA firm that gives proper pay to its employees, you can even join it to gain experience and also see for yourself how the system works.

For working in CA Firm you dont need to have any IPCC. In the market (employment) its not qualification but competence that matters.

Qualifications are needed only for purposes of expert jobs.

As to your questions:

1. Yes, the President ICAI has said that so that is correct

2. I am not sure whether your BBM would qualify as BCom (plz read the link – it says “…commerce graduates/post-graduates and have studied any three full papers…” So you should first check whether you have studied the three papers – and thereafter check with ICAI whether they would consider your BBM as equivalent to BCom

Secondly, if you see – the proposed changes does not anywhere speak of migration of current CPT students even if they are graduates and eligible for CPT exemption – so all that would really depend on ICAI as to what kind of rules they finally make.

3. It has been said that after a few procedural requirements – that may take upto 2 months – the proposed changes would be implemented. So may be sometimes by end of December 2011.

I would suggest directly ring up the Articles section of your region – and ask them whether you have been registered.

You can work as full time employee even without being a CA

I have even seen accountants working in private companies who have qualification BA (Political Science) and they are earning around 12,000 per month in mofussil towns ! And without any prior training, doing their work on the job, they have become experts in Tally !

There is Form 120 that would be applicable in your case.

However ICAI has changed some ground rules – by putting in new rules for Form 120 (see instructions in the form). Now only two criteria for Form 120 is specified (such restriction was not there before) – medical & parent’s transfer

So,in your case, that does not solve your problem.

Despite of above, ICAI currently allows termination in first year without restrictions – that termination is possible only by mutual consent of the Principal

So, I guess you will have to work on your Principal – tell him your situation and problems. And may be come at an agreed date when he would provide termination. Remember that its you who asked for articleship under your Principal. He did not go to you.

The rule as it seems is that the training for ATC cannot be set-off with Articleship under IPCC

Under Intermediate / PE2 / PCC the set-off is possible. Reply to Q 36 of the ATC FAQ says:

But it is not the new employer that provides the number. The new employer intimates its RPFC that a new employee has joined and then the RPFC provides the new number

Transfer (on Form 13) has to be initiated after one has received the new EPF number. The new employer does not initiate transfer and the transfer does not happen automatically. It happens only when one applies for it as per procedure (which you have read in the article).

The earliest you join, the earliest you would be able to appear in Finals.

(as i have often observed, e-sahayata does not always provide sahayata. had that been the case, I would have stopped replying on this blog)

1. You have confirmed on phone – and in records of institute it is three years

2. Your registration form clearly specified you to be IPCC stream and IPCC has three years training

If you still want to be reassured, you can do one thing. Write to Articles section of NRO on e-sahayata and ask them something like:

Kindly let me know what would be the last date of my articleship training as per institute records – whether it would be 20-Feb-2014 or 21-Feb-2014

My articleship will be completed on 13/02/2012. As ontoday i have 30 days credit as allowed by the institute (1/6) of the total period served. I want to have leave for my final exam from 01/11/2011 which results into excess leave of 74 days.

As per my principal my articleship extension will come upto sepember starts from 15/05/2011. I am not able to understand the logic behind the same. How my extra leave of 74 days result into extension of 137 days ?

Pls guide me in the matter and tell whether the calculation done by my principal is right ?
