So, Debit card does not work – primarily because, of two reasons – 1) Debit Card issued is related to Indian Rupee – so cannot be used for payment in foreign currency, and 2) Debit Cards are considered to have other limitations as to transaction value. So, in India, while you can verify yourself using Debit card, you cannot use it for purchasing in foreign currency. (However not all Debit Cards get added. I have found that Axis Bank debit card can get added for verification purpose. However, its better to verify using bank a/c)

However, credit card can be used for purchase using paypal or even without paypal.

The Principal cannot deny industrial training. Logically if you have gone through rules, you can complain to ICAI. (To keep a record, you can ask for the office seal of receipt, or apart from the handwritten application, also send an email application to his/ her email address.)

The number of days of excess leave – on your due date – has to served in addition – after 11-8-2014.

What has your Principal said? He must be knowing the details. The other point is, as 102 is an agreement (contract), and you are in a foreign country – then, will the local laws on contract be applicable? Get that clarification from your Principal / Institute

As to the other issue – articleship can only start after 102 is executed. So even if you have ‘joined’ – your articleship has not started (so you are not eligible for Nov 2014)!

However this excess leave is a misnomer – as excess leave can only be calculated at the end of 3 yrs of articleship.

The total eligible leave in 3 yrs training is 155 days.

You would be eligible for May 2014 attempt, if your articleship finishes (including excess leave) before 31 October 2014

If you would have registered till Apr 30, you would have been eligible for Nov 2014 Finals.

However, as its now May 1 – then to be eligible for May 2015 Finals, you have to register on or before Oct 31, 2012

Registration for articleship means the date of 102 (articleship agreement)

As your case involved re-registration after long gap, perhaps they have some query.

As to the 9 / 12 months – that is inclusive of eligible leave period.

Plz also ask e-Sahayata if there has been any change in the rule. Usually ICAI permits one additional course. eg. if you check the ICAI link, it does not mention CS – however there are many students who do CS simultaneously as an additional course.

‘CMA in practice’ is a difficult question. I have seen CMA s with no work – even doing CA and later on practicing as CA – while at the same time, I have seen CMA s with tons of work in practice

Once I met a young CMA who had gone for representing his client (a big national level steel plant) – to Jt Comm (Central Excise) – and he had 16 cases with him to argue that day !!!

As such the lobby of CMAs are working quite good. Recently, there is a proposal with govt that Tax Audit, which is currently a preserve exclusively of CA s should also be opened up for CS and CMA.

You can join articleship with 112. Take the certificate from college that the regular classes are over.

As to ‘lenthy process’ if you do CA, then you will find much more ‘lenthy’ procedures and forms to fill and pursue – the audit reports, the income tax forms, the compliance reports, etc etc. 112 is only a small form / process in comparison

Some time I feel that with all these forms like 102, 103, 112, 107, 108, 109 etc ICAI gives the student a ‘snapshot’ of what is to come !

However registration of CPT has a limiting period of 3 yrs. If your 3 yrs period has passed, then you have to get your registration validated by sending Rs. 500 DD to ICAI

Though ICAI says 3 months, it really depends on the Principal. Speak to him verbally about of your intention to do industrial training. Ask him when he can give you termination. And thereby arrive at a mutually agreeable date.

I am currently pursuing articleship from a mid size firm in Mumbai. My third year of articleship begins in August 2012 and my final CA attempt is in May 2013
I have two queries:

All these really depends on the relation between Principal and Article.

Yours is just a matter of 20 days – talk with your Principal, because 108 can be sent even upto 3 years after completion of training.

If suppose you apply for an internal auditor’s position in a listed company, they would definitely like to hire someone who has exposure with audit of listed companies.

In reality one may be enrolled in regular college but never go to college. But that is not how things work. If you are enrolled in regular college it is a presumption that you are attending college. And if you are attending regular college in a different city, the only conclusion is that you are doing articleship by dummy. And that would be big trouble for you.

So either do BCom by correspondence or even if regular, see that it does not clash with the office time. You would have to anyway fill form 112 if you want to pursue additional course like BCom alongwith articleship.

Secondly it is not clear what your excess leave actually is. In a total period of 3 yrs training, the excess leave is number of days exceeding 155.

Now the point is that your training officially ended on 30-4-2011. For this you will have to send 108 + condonation + late fee.

After this you have the problem. ICAI or anyone cannot over-ride the law of the land. And under current laws there is no provision that can make back dated agreement valid by using current date stamp paper (This is primarily a measure to check frauds).

It is not clear how your Principal not check this thing.

If you want to regularise the training, then you have no option but to execute the deed from current date for the excess period.

The thing is – a transfer would either happen or it would not happen – but your money wont be lost!

It is difficult to fight with the HR. So do as they tell you – if transfer happens, well & good. (I hope they have previous experience in getting transfer done their way)

If it does not happen, you can later (after 8 – 10 months) again re-initiate in a proper way.

The full period that you did not attend office from Jan to Mar would be considered leave – by rule it should be paid leave (but I guess in your case 109 is more priority than couple of months stipend).

Since it seems you have obtained a job and not willing to continue articleship, I would suggest obtain 109 upto date prior to your joining employment and before the expiry of one year.

This is because, if you keep your papers in order, and may be some months/year later, you think you want to do articleship again and want to be a CA, then you wont have problem in re-registration.

The form 109 does not mentions excess leave – it only mentions leave.

However, since you have raised such question, I would give an example:

Suppose a student joins articleship on 1 Jan 2011 and takes transfer on 30 Dec 2011. He has taken leave of say 7 months during the year. In such case even though his leave is in excess (when calculated pro-rata), he would get transfer.

However suppose, in the same above case he takes transfer say on 5 Jan 2012 – then he is already past his first year of training. Eventhough his leave is in excess (7 months), he wont get transfer, because he has entered his second year of articleship.

The period of one year is calculated as per Deed (102). It has nothing to do with what leave the student has actually taken

Compensatory off in your present firm would not be set-off by another CA.

However generally, in one year industrial training the max leave allowed is one month or two month – not more than that. Even if you have say 5 month eligible leave remaining, they wont give you so much leave, as the very purpose of industrial training would get defeated.

1. Request your Principal to send you for assignments of any of his colleague who might be having works like statutory audits of banks / insurance companies / Corporate Sector listed companies. Usually such informal arrangement exists among CA s.

2. Another way is that you find for yourself such firm / CA, and go for secondment. Secondment can be for minimum 4 months and max 1 year.

The difference on the monetory front is that by rule, the CA stipend is very less (though in some firms, they pay more), while the CMA stipend is by rule more. Besides the three years training in CMA can be taken in an industry. Also, in CMA one can do actual service in specified type of companies, and get set-off for work done.

Balance period remaining 1095-298 = 797 days

This balance 797 days have to be completed prior to 31 Oct 2014 so that you are eligible for May 2014 exam.

(Also, if I remember correctly, the conversion from PCC to IPCC, there was an option provided to PCC students to take termination. If your termination relates to that, then there is nothing to worry – as the normal termination / transfer rules would not apply to your case)

You will have to serve the balance period of your 3 & 1/2 years articleship under the new CA by again filling the form 103 & 102 for the balance period. As now you are in Finals, while obviously you can send the Final enrolement & 103 separately, but I hear that nowadays ICAI does not issue the articleship registration till it receives the Final enrolment fees – it just sends you a letter for the pending fee.

Also if you belonged to the exempted enterprise (ie. your company maintained the PF Trust), then your application has to be sent to the PF Trust of your company with a copy to the jurisdiction RPFC.

Now, the jurisdiction RPFC may be local RPFC of the place of posting, or the RPFC of the place where the Head Office of the company is situated. Like some big companies prefer to control the EPF system from the head-office. So in such cases the jurisdictional RPFC would be the RPFC of the city where your company has registered with EPFO.

So plz check what you have written. It would seem to me that your company’s trust is in Durgapur, while the jurisdictional RPFC is centralised and located at Delhi. In any case, there has to be only one Form 13 (plz read the instructions on top of Form 13).

Now, given your situation (as you have written), Firstly it would seem that ICAI has misplaced your 109 – and therefore in records you are doing articleship ! Now you want to resubmit 109 again. I would suggest, instead of going through such procedure, why dont you obtain 108 for 24 March 2012 (with mention of excess leave), and thereafter join any CA of your choice with new 102 & 103. That would also keep your paper-work clear. If you want to continue with the same Principal you can fill 107.

The last company maintains the PF under exempted trust maintained at Durgapur & pension fund is maintained in EPFO,Delhi. Ive filled up the form -13 separately one for trust & other for pension fund transfer & got it attested from present office with covering letter. Now tell me whether I’ve to send both forms addressed to trust at Durgapur from where they will send to EPFO delhi for pension fund transfer or PF tranfer form to trust at Durgapur & pension transfer form to EPFO,delhi.

I am not aware of any transfer rule in ATC. I dont think that transfer is allowed in the one year training – unless perhaps the same organisation has branches elsewhere.

Infact, ATC is not governed by ICAI articleship rules of training – they are governed by the organisation’s rule where the student is taking training.

Eligible leave= 1/6*(Total Days – days of leave).

The more you take leave, the eligible leave decreases and after a point (155 days ‘conservative’) goes negative (excess leave). So, the leave allowable is 155 days. If you dont take any leave, then as per formula your eligible leave would be 182 days !!!

That way you would save unnecessary complications – however,just see that you finish your extension prior to Oct 31, else your results would be invalid)

The point is – your articleship should be over “on or before 31st October, 2012 ”

Now from what you have written, your normal period of articleship ends on 4th Feb, 2012.

In addition to that you have extension of 123 days.

That is your extended articleship is completing on 7th June

Now, as per rules during extension, leave is not allowed !

Given this situation, its better you fill the 7th June as the last date.

The date of joining would be the date put on Form 102 (the articleship deed) – that would be signed between you and your Principal.

Depending on time available, some CA’s may execute the 102 on your very day of joining or within a week. However, the important thing for you is that the 103 should be sent to institute within one month of joining. (102 is not sent)

Franking date has to be prior to the joining date mentioned in From 102

The firm may seem small, but you get to have direct interaction with your Principal and get to learn things.

Usually all problems arises because there is no proper communication – so always keep your communication clear – never shy from asking any question from your Principal.

At my time, my Principal was ready to give me termination for industrial training the very next day – but then not all Principals are same.

In case you have given adequate notice – then put in a complaint to ICAI through e-sahayata.

So, I would suggest that you try to search firms locally ie. in your district or in a place where you have proper residence.

Actually the thing works like this – when you pass CA and fill the membership form, your form gets scrutinised (in an extreme way). I have seen cases where those who having passed CWA and thereafter enrolled for CA, when they applied for membership – letter came to them asking why did they do additional course – so they had to clarify that they had finished it prior to even joining CA course and that they did not do any additional course during articleship !

Moreover, one cannot make false declaration in forms filled with ICAI – because that is considered misconduct !

I can only tell you what I have seen happening. ICAI wants students to be dedicated professionals – and so all these rules

1. my son passed plus two in 2010 march and appeared for cpt 2010 june and passed and registered for ipcc
2. he had applied for bcom distance mode in 2010-11 and completed first year. he is going to appear second year in 2012 may

3. he applied for icwa foundation and passed in 2011 june and registered for icwai inter in 2011 december intent to appear for inter in 2012 june

4 now according to rules he decided to continue only bcom and will complete by 2013 final bcom

5 after bcom, he want to appear icwai interi n 2013 december

6. in the back drop he started his article ship 2012 february after passing of ca ipcc group 1

7. he registred bcom and icwai before commencement of articleship

8. now what should mention in 112 form now

9. after degree completion 2013 may, whether icai will give permission for icwai inter december 2013

And as per ICAI rule, the student can pursue only one additional course during articleship.

As far as I know, ICAI gives permission for one additional course serially ie. one course at a time.

(The institute is actually very sensitive about any student taking additional courses during articleship, as it thinks that it would hamper proper articleship training for the CA course)

2. Your new date of completion would get extended by 12 days (Feb does not have 30 days). So considering you take termination on 29th, and rejoin on 12th March – your new completion date should be 27 Sept 2014 (provided you dont take excess leave)

3. Such thing does not happen – the 12 days would just be a gap in articleship – no problems with such gap.

So if your normal period of leave in previous firm was less than 155 (assuming that you are from IPCC), then you fill the 103 for the remaining balance period of articleship training without taking account of the excess 78 days.

With Form 103 you should be sending the usual attachments that you sent in the beginning + the letter of termination received by the institute. As to other documents to be sent in case of delay, read:

Under IPCC, the student should be serving last 6 months of articleship training inclusive of excess leave.

Suppose a student’s articleship training is getting over in March 20, 2015. But s/he has taken 300 days leave. As max permissible leave is 155 days – so the student would be having excess leave, and therefore not be able to appear in Nov 2014, even if his normal period of training is ending on March 20,2015.

1. As per ICAI, coaching institutes should be conducting classes outside of office hours (ie. prior to 9.30 AM and later than 5.30 PM).

2. Taking excessive work is basically a personal perception as to what is excessive. However, usually in general work exceeds normal office time – and very rarely set-off is provided. As per rule an Article is required to do 35 hours of work per week. Also as per rule, in rare instances where work exceeds 40-45 hours, then set-off should be provided for excess hours worked. However in practice these rules are usually not followed – or followed only in normal times (ie. excluding the ‘audit season’ / ‘tax season’)

3. For Delhi, I would say 1000 – 3000 stipend is low. 1000 is the minimum that ICAI prescribes. Usually firms prefer to pay higher stipend to compensate for excess hours. Set-off in form of leave is not given, instead set-off in form of higher stipend is provided!

Out-of-Pocket expense is something extra in excess of stipend that is provided to compensate the Article for expenses while on work outside the office eg. if the student is going on an outstation audit, then s/he would need to stay in a hotel, need to have lunch /dinner, travel by bus/ train. Often the Auditee meets these expenses (either directly or is added to his bill)- but sometimes they may not be meeting these expenses, instead they pay a consolidate fee to the Auditor – so in such cases a good CA would provide his Article with the out-of-pocket expense

Introduction : I have cleared both groups of IPCC in 1st attempt (I gave group-1 in May’11 & group-2 in November’11) and I have given Interviews in 4 mediocore firms in New Delhi and I have been selected in all 4 of them but I am confused as to join which one. I dont want to disclose their names, considering our Professional Ethics.
Problem : My main problem is that they all are not allowing me to do coaching, their office hours are such that articles need to work for 50 hours a week and stipend is ranging from Rs. 1000 to 3000. Please suggest me whether most of the CA firms:-
1.Allow coaching?
2.Take excessive work from articles?
3.Give such stipend in which only out-of-pocket expenses are met by articles?
so that I am able to join any firm whose work and stipend is the highest.

You will have to adopt similar procedure by adapting it to your situation – in your case the most important document is the PE-2 registration letter and PE-2 to IPCC conversion letter.

As you are filling the CA final registration, fill in the correct data ie. 3 years

As your articleship started on 11-09-2010, your eligibility for Finals would come in Nov 2012. (ie. in the last year of articleship) – so get the data corrected in ICAI records at the earliest.

All CA firms are recognised.

If you want to go for employment after qualifying, then better to do articleship training in some big firm.

As to your call for interview – that would depend on your marks & in how many attempts you have cleared. Rest of the thing would depend on your communication skills at the interview.

Else, if you have finished articleship from Mumbai, then obviously Mumbai

But if you have finished articleship from central region, and is currently located at Mumbai, then I would suggest you speak to ICAI on phone – or put the query on e-sahayata

You can definitely appear in May 2012.

You will have to send the application form for May 2012 – and if you are filling online, then you would have to register again on the icaiexam website to get the login id.

If you have registered for both groups, then you cannot register for ATC. This is because, for ATC there is a separate training of one year, and under IPCC the three year training of articleship is not set-off for purpose of ATC

ICAI also has procedure for issuing of duplicate identity card. First speak to the articleship section of your region on phone on this matter, and then act accordingly

As per rules, during first year of training, transfer is by mutual consent. If your Sir agrees, then you get transfer. If he does not agree you dont get transfer. Its as simple as that.

So be careful.

When one passes one of the groups, then that group is exempted. ie.one cannot surrender the pass in the group.

For second & third year permission for transfer has to be taken from ICAI prior to transfer application (109).However for cases like going for industrial training, no permission would be required. If you are comfortable with working of Big 4 (in general, if you want to join corporates after qualifying), then give first preference to Big 4.

Remember that currently – in general AAPE has stabilised, SFM & CM & ISCA would not change – the rest would definitely undergo huge changes by the time you become eligible for finals.

Services of CA s are required by usually the wealthy ! So in a way it does not really matter under whom one does articleship. Usually anyone having 10 years of practice in general would be having a good clientele.

The only difference comes in areas where (only big firms usually) do audit of listed companies. If ones clients includes NRIs, one gets exposure in those areas. If the client includes MNCs, one gets exposure in areas of transfer pricing. If the clients includes manufacturing companies (can be with small or big firms) one can get to work in areas of central excise.

Other than these, you would find audit and income tax everywhere

I want to know that what is group exemption in ca exams.

I have cleared both groups of IPCC and mow undergoing training in LUTHRA & LUTHRA from 10th oct’11 to till date but now i wish to take transfer due to some problems. I have contacted many firms(top 25 CA firms ) in delhi but they are saying they dont have any vaccancy.

I have cleared my IPCC group 1 exams this november. I have also completed my ITT and orientation course.

Is there any other requirement before i join for articleship? And is there any form to be signed before joining articleship from the principal?

I can only say that you should use your own wisdom ( विवेक ) in deciding. Everyone is having a perception of articleship – what is your perception? Do you think if your Principal sends you to deposit cheques that you would find as if you have been ‘insulted’?

If you do more than one course during articleship, then you would be in big trouble.

During articleship only one additional course is allowed that should not be a regular course during office hours
