Sir , one of my friend has enrolled for 2 courses and is pursuing articleship. But of late he is not doing the cwa course and has not even submitted the cc paper forget about giving exams. He has told icwai institute to deregister him form course but they tell tht he simply need not give exams. hence his request is of no use. Sir please advise me as to what should i tell him as he is in severe tension since he fears that his articles will be cancelled. Sir please advice at earliest.The other course he is doing is icsi (in finals appeared). He has not filed 112 for icwai.

As he does not intend to do that course, just forget about it. When he fills the form of membership, there would be no cwa mentioned, and therefore, nothing is going to happen. No point of tension.
Sir, I just wanted to know that weather CA institute will come to know that a person is doing another course (icwai) , if the person does not inform the ca institute of the same (doing 2 course) by not filing second form 112.

My only advice to you would be that you give more respect to your signature in declarations of the kind “I declare that what is written is correct and true to the best of my knowledge and belief”. Its not just a question of ICAI finding out what. Of-course when it finds out, it takes disciplinary actions.
Sir, i have applied for the transfer on mutual grounds. How much time institute takes to revert back. Suppose if they dont permit, will they send me a letter atleast?
What do you mean by ‘mutual grounds’ – there is no such ground. However, if by that you mean ‘mutual consent’ between you and your Principal, then that clause is presently redundant. As per normal correspondence practice, ICAI should send you reply to your letter – but it does not. ICAI sends letter only when it requires further clarification – else you wont get any reply. As for time, three – four weeks is a reasonable time.
However, if you are in first year of articleship, – then the clause of ‘mutual consent’ (between you and your Principal) stands valid.
Earlier also, when there was no such restrictions, one could take termination based on mutual consent. There was no need to justify as to the reasons for the mutual consent.
For first year of articleship by removing the restrictions, that clause of mutual consent has again become operable. (As per the July 2010 notification, restrictions on transfer / termination in first year of articleship has been removed).
So is there any other way because my principal and me are not at all on good terms

sir i am doing articleship but not getting exposure as much i want so i want to take transfer. my sir is ready to give transfer but cant get any reasons due to which i can take transfer. and according to the recent rules my two years of articleship has completed so it is also not helpful to me. sir can u plz help me.
This is a problem with most of the smaller firms, that they are not able to provide adequate exposure to their articled trainees. So, if you are in Finals, go for Industrial Training. If not, you have option to take Secondment (four months min, and one year max).
However, the best thing, is often to talk to your Principal’s CA friends who have the kind of audit that you would like to do. So, if someone has internal audit of bank, or someone goes for statutary audit of bank, or stock audit of a company or bank or any such assignment – then request your Principal to talk to such CAs – and work with these CAs on such assignments for an agreed upon duration.
Such kind of practice is fairly common – where CAs often share manpower available! In doing this, you would get the variety of experience – as well as it would not require unnecessary procedural compliance of ICAI.

and ICAI organised Campus Placements not only for fresh CA’s but also for experienced CA’s as well which gives a huge boost to the profession as a whole.

The termination process in India would be the same, and I understand the process of re-registration would also be the same (same procedures same forms etc.) Only how it would be processed from Nepal, I am not aware. For that I would advise you to write an email to bosnoida@icai.org and also post a query at http://www.icai.org/help/
as per latest rule can i take tranfer from articleshp within the 1st year and that too in same city?
do i need to file form 109 first or have to take institute’s approval first?

Permission from ICAi not required in first year. Yes you can take transfer in same city.

Also, as you are taking transfer after 2.5 years of articleship, you would be governed by the restrictive new rules. However marriage is a permitted reason for allowing transfer. So, please see that in the covering letter, your Principal clearly mentions the reason of your transfer. You can even attach copy of your marriage card / certificate with the covering letter as proof.
Sir, I completed 2years and 8 months articleship.I am Physically handicap with 40% disability. Office where my articleship is running is situated on 6th floor plus ground floor. Lift of that building is not working properly most of the time and building is also in repair condition upto 1 year. Because I am handicap I have to climb 7 floors almost everyday for last 3 months my CA want to give me transfer from articleship. I already applied for it before 25 days to the Institute but I have not receive any reply from Institute.
Because I have not receive any reply my CA not want to continue with him because trouble cause me to attend office. Can I terminate from the articleship before permission of Institute?

good afternoon sir, i have completed 2 yrs of training and have cleared only one group of PCC. My principal is very rude and arrogant with me. He is only bothered about his work.he is not giving me leaves for this nov attempt. I have also asked for transfer but he denies for the same. Do i have any remedy as i cant work with him
ICAI stipulates that the Article can take (total) 3 months leave for exams during the period of articleship. This period of leave the Principal cannot deny.
Actual appearance at exams (notwithstanding results) including intervening gaps is counted as part of articleship.
However if you have already taken this duration of leave for any of your previous attempt, then thereafter, the discretion is entirely at the hands of the Principal, whether he allows you leave for the exam or not.
As to your problems with your Principal – I have not found a single student who is not having problems with his /her Principal. Take it as part of your career and learning experience – as how you deal with a problematic boss. In real life nearly all bosses would be problematic – and when you become the boss – even if you are good – your subordinates would be unhappy – thats a real life ‘rule’ !
As for transfer, since you have already done 2 years of articleship, you need to have a ‘reason’ as per the norms laid by ICAI for the transfer. Under the new rules (from Aug 2010) its only in first year of articleship that one can take transfer without providing for any reason
